Frank Candor — Terms of Service

These Terms of Service ("Terms") govern your use of Frank Candor ("Frank", "the Service"), operated by Unseen Co. ("we", "us", "our"). By using Frank, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Frank Candor is an AI-powered career advisory service delivered via WhatsApp. Frank provides perspective, analysis, and strategic thinking about your career situations. Frank uses artificial intelligence to generate responses.
Frank is not a licensed career counsellor, therapist, lawyer, or financial advisor. Frank's advice is informational and for general guidance only. It does not constitute professional, legal, financial, medical, or therapeutic advice. Always consult qualified professionals before making significant career, legal, or financial decisions.
2. Eligibility
- You must be at least 18 years old to use the Service.
- You must have a valid WhatsApp account.
- You must comply with WhatsApp's and Meta's terms of service.
3. Your account
- Your WhatsApp phone number is your account identifier. There is no separate login.
- You are responsible for all activity on your account. Do not share access to your WhatsApp for the purpose of using Frank on behalf of someone else.
- We may suspend or terminate your access if you violate these Terms.
4. Acceptable use
You agree not to:
- Use Frank for any unlawful purpose or to facilitate illegal activity.
- Send content that is abusive, threatening, defamatory, or harassing.
- Attempt to extract, reverse-engineer, or replicate Frank's system prompts, training data, or proprietary methods.
- Use automated scripts, bots, or tools to interact with Frank at scale.
- Share confidential information belonging to third parties without their consent (e.g., another person's performance review, medical records, or private communications).
- Impersonate another person or misrepresent your identity.
- Use the Service to generate content intended to harass, defame, or harm others.
- Circumvent rate limits, security measures, or access controls.
5. AI-generated content
- All responses from Frank are generated by artificial intelligence. They may contain errors, inaccuracies, or incomplete information.
- Frank's responses reflect AI-generated analysis, not the opinions of Unseen Co. or any human advisor.
- You are solely responsible for decisions you make based on Frank's output. We are not liable for outcomes resulting from reliance on Frank's advice.
- Frank may occasionally produce content that is inappropriate, inaccurate, or not applicable to your situation. If this happens, let Frank know and the response will be adjusted.
6. Privacy and data
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. Key points:
- Your messages and career data are processed by third-party AI service providers to generate responses.
- We do not sell your data or use it for advertising.
- You can request export or deletion of your data at any time (see Privacy Policy for commands).
7. Intellectual property
- Our IP — The Frank Candor service, brand, system prompts, algorithms, and proprietary methods are owned by Unseen Co. All rights reserved. You may not copy, modify, distribute, or create derivative works from any part of the Service.
- Your content — You retain ownership of the content you send to Frank (messages, documents, files). By sending content to Frank, you grant us a limited, non-exclusive licence to process, store, and analyse it solely for the purpose of providing the Service to you.
- Generated content — Documents Frank generates for you (CV drafts, summaries, reports) are provided for your personal use. You may use them freely. We claim no ownership over content generated specifically for you.
8. Subscription and payment
- Frank offers free and paid tiers. Features available on each tier may change.
- During early access, all users receive full access at no charge. When paid tiers launch, you will be notified in advance.
- Paid subscriptions are billed through Stripe. Payment terms, refunds, and cancellation are governed by the terms presented at checkout.
- We reserve the right to change pricing with 30 days' notice.
9. Service availability
- We aim to keep Frank available 24/7 but do not guarantee uninterrupted service.
- The Service depends on third-party infrastructure including WhatsApp, AI service providers, and cloud hosting providers. Outages in these services may affect availability.
- We may modify, suspend, or discontinue features at any time with reasonable notice.
- Scheduled maintenance or critical updates may cause temporary unavailability.
10. Limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied terms as to merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by law.
Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded under the laws of the Hong Kong Special Administrative Region, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
Subject to the paragraph above and to the maximum extent permitted by law:
- Unseen Co., its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total aggregate liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or HKD $1,000, whichever is greater.
- We are not liable for any career decisions, job changes, negotiations, or professional outcomes resulting from Frank's advice.
- We are not liable for data loss caused by third-party service failures beyond our reasonable control.
11. Indemnification
You agree to indemnify and hold harmless Unseen Co. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any third party's rights.
- Content you submit to the Service.
12. Termination
- You may stop using the Service at any time. Send "delete my data" to remove your account and all associated data.
- We may suspend or terminate your access at any time for violation of these Terms, abuse of the Service, or at our discretion with reasonable notice.
- Upon termination, your right to use the Service ceases. Data deletion follows the process described in our Privacy Policy.
13. Governing law and dispute resolution
- These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China.
- Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation.
- If negotiation fails, the parties submit to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region. Nothing in this clause prevents a party from seeking urgent injunctive or equitable relief in any court of competent jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via WhatsApp. Continued use after changes constitutes acceptance of the updated Terms.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
16. Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Unseen Co. regarding your use of Frank Candor.
